2. Description of the Service
SnapMenu is a B2B SaaS platform designed for restaurants and hospitality businesses (HoReCa).
The Service provides tools including, but not limited to:
- Digital QR menus
- Direct online ordering systems
- AI-powered virtual waiter
- Voice ordering functionality
- Online payments via third-party providers (Stripe)
- Nutrition and allergen information tools
- Branded ordering apps and custom domains
- Setup and migration services (Premium plans)
SnapMenu is not intended for consumers as contractual users.
3. User Types
The Platform supports the following user categories:
- Business Users (Restaurants / HoReCa operators) – contractual users of SnapMenu
- Account Administrators – managing business accounts
- End Customers (Guests) – may view menus and place orders, with or without creating an account
End Customers are not contractual parties to these Terms.
4. Eligibility
You must be legally able to enter into binding contracts to use SnapMenu as a Business User.
By registering, you confirm that you are authorized to act on behalf of the business entity you represent.
5. Account Registration and Security
You are responsible for:
- Maintaining accurate account information
- Protecting login credentials
- All activities performed under your account
⚠️ SnapMenu is not liable for unauthorized access caused by your failure to secure your account.
6. Payments, Subscriptions, and Billing
- Subscriptions may be monthly or annual
- Payments are processed via Stripe
- Billing is automatic
- No partial refunds are provided
- A Free Account (trial) is available with limited functionality
- Subscriptions may be cancelled at any time, with access remaining active until the end of the billing period
SnapMenu does not process payments directly and is not a payment processor.
7. Responsibilities of Restaurants
Restaurants are solely responsible for:
- Menu content, descriptions, and pricing
- Ingredients, recipes, allergens, and nutritional data
- Order fulfillment and food preparation
- Food quality, safety, and delivery
SnapMenu does not prepare, handle, store, or deliver food.
8. AI Features Disclaimer
SnapMenu includes AI-powered features such as virtual waiters and voice ordering.
You acknowledge and agree that:
- AI provides informational assistance only
- AI does not provide medical advice
- AI outputs are not guaranteed to be error-free
- Final responsibility remains with the restaurant

9. What SnapMenu Does Not Do
SnapMenu is not:
- A food delivery operator
- A payment processor
- A guarantor of menu or allergen accuracy
- Responsible for food quality, preparation, or delivery
10. Acceptable Use
You agree not to:
- Upload illegal, misleading, or harmful content
- Violate applicable laws or regulations
- Abuse, disrupt, or reverse-engineer the Platform
- Use SnapMenu for fraudulent or unauthorized purposes
11. Suspension and Termination
SnapMenu reserves the right to suspend or terminate accounts, with or without notice, in cases including but not limited to:
- Non-payment
- Abuse or misuse of the Service
- Illegal or prohibited content
- Violation of these Terms
12. Intellectual Property
All intellectual property rights related to SnapMenu, including software, branding, and content, remain the exclusive property of Emporio Velathri SRL.
You are granted a limited, non-exclusive, non-transferable right to use the Service during your subscription.
13. Privacy and Data Protection
SnapMenu processes personal data in accordance with applicable EU data protection laws (GDPR).
A separate Privacy Policy governs how personal data is collected, used, and protected.
14. Limitation of Liability
To the maximum extent permitted by law:
- SnapMenu shall not be liable for indirect, incidental, or consequential damages
- SnapMenu is not liable for loss of revenue, data, or business
- Total liability shall not exceed the fees paid by the Business User in the 12 months preceding the claim
15. Indemnification
You agree to indemnify and hold harmless SnapMenu and Emporio Velathri SRL from any claims arising out of:
- Your use of the Service
- Content provided by your business
- Food-related incidents or regulatory violations
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Romania and applicable EU law.
Any disputes shall be resolved exclusively by the competent courts of Romania.
17. Changes to the Terms
SnapMenu may update these Terms from time to time. Updated versions will be published on the Platform.
Continued use of the Service constitutes acceptance of the updated Terms.
